Terms & Conditions

1. Introduction

RM50 e-wallet Credit Giveaway Contest (“Campaign”) is organized by ITS Management Sdn Bhd - Organizer of Alibaba GET Global Challenge 2020. (“ITS”). This Campaign will commence from 23 March 2020, 10.00am (GMT +8) to 30th April 2020, 11.59pm (GMT +8) (“Campaign Period”). ITS shall reserve the rights to shorten or extend the Campaign Period at its sole discretion without prior notice.

2. Campaign Mechanism

In order to participate in this Campaign, Participants are required to complete all the following steps: -

a) Like Alibaba GET Global Challenge - Malaysia FB Page (http://www.facebook.com/AlibabaGETGlobalChallengeMY/)


b) Share the post: http://www.facebook.com/102293091399161/posts/116151563346647/?sfnsn=mo (“Event Post”) and  make sure his/her post privacy setting is set to public;


c) Tag 3 of your friends & include #AlibabaGETChallengeMY in the COMMENT section of the Event Post.

3. Eligibility

a) This Campaign is open to Malaysian residents only.


b) Employees of ITS, their immediate families, partners, advertising, creative and public relations agencies, program organizer, their employees and immediate families are not eligible to participate in this Campaign.
 

c) Participant must register as a user on Facebook and must own an individual public Facebook account through which he/she can participate with this Campaign.


d) Only one entry will be accepted per Facebook individual account. Multiple entries from the same person will be disqualified.
 

e) ITS reserves the rights to disqualify any Participant at its sole and absolute discretion, without having to assign any reasons whatsoever.

f) By participating in this Campaign, Participants are deemed to have reviewed, read and accepted the Terms and Conditions. If Participant is below eighteen (18) years of age and above as of 5th February 2020, the parent / legal guardian of the Participants must read and agree to the Terms and Conditions upon the Participant’s participation in this Campaign.

4. Judging Criteria

a) Only sixty (60) winners for the Prize will be selected for this Campaign.


b) Campaign winners will be announced on Alibaba GET Global Challenge - Malaysia Facebook (www.facebook.com/AlibabaGETChallengeMY). It is the responsibility of the Participant to follow this announcement.

c) Participant who fulfilled the “Campaign Mechanism” set out in Section 2 of this Terms and Conditions are eligible to stand a chance to win the Prize for the contest. Entries will be selected and ranked based on the following:-

i. The Participant completed all steps of the “Campaign Mechanism” set out in Section 2 of this Terms and Conditions within the Campaign Period; and


ii. Sixty (60) winners will be selected by lucky draw conducted by ITS at ITS’s office.


d) The decision of ITS is final, and no enquiries, verbal or written, shall be entertained.

e) The winner will be announced on Alibaba GET Global Challenge - Malaysia (www.facebook.com/AlibabaGETChallengeMY) on 1st May 2020. The winner will need to and agree to send a Private Message to Alibaba GET Global Challenge - Malaysia (www.facebook.com/AlibabaGETChallengeMY) with his/her contact details for collection of the Prize.  ITS shall reserve the rights to reschedule the Winners Announcement without prior notice.

5. Prize
a) The winners of this Campaign will win RM50 e-wallet Credit (“Prize”).


b) The winner shall be responsible for all costs in connection with the redemption, collection, delivery and/or perfection of his/her Prize, including but not limited to legal cost, stamp duties, registration and transfer fees, taxes, insurance, spending money and related expenses (such as meals or personal expenses, upgrades, etc.) or fees.

c) The Prize is not exchangeable, transferable or redeemable in any form for whatever reason.

d) Prize not claimed within one (1) day from the date of the announcement of Campaign results by ITS on Alibaba GET Global Challenge - Malaysia (www.facebook.com/AlibabaGETChallengeMY) shall be forfeited. The Prize will thereafter be deemed to have lapsed unconditionally and irrevocably. The Prize shall be claimed personally by the Campaign winner. The winner whose Prize has been forfeited or unclaimed is not entitled to any payment or compensation from ITS notwithstanding non-receipt of notification that he/she is a winner.

e) Winner shall accept the Prize as it is. ITS makes no representation or undertaking as to any implied terms and conditions with respect to the Prize in this Campaign.

f) ITS assumes no liability or responsibility in respect to the nature/consumption of the Prize and will not entertain any direct correspondence with anyone in this regard.

6. General
a) The Participant agrees and provides consent to ITS to the use of any Personal Data as provided by the Participant for the purpose of participation in this Campaign in line with the Personal Data Protection Act 2010, to the extent that any personal data provided shall only be processed and be used by ITS for lawful purpose directly related to the running of this Campaign including but not limited to the purposes of promotional events, advertising, marketing and any administrative matters to facilitate the management and organizing of this Campaign.


b) By providing the personal data, the Participant agrees that ITS and/or its agent and/or its third-party service providers may contact them by telephone, email or such other method in connection with this Campaign.


c) Winner may be required to participate in a photo taking session during the issuance of the prizes as collection proof upon collecting the prize.


d) In the event any prize is being awarded to the participant having provided false or mistaken identity or information, ITS shall have the right to revoke the participant’s eligibility for the said Prize.


e) Prizes given are non-refundable.


f) Prize winner shall not substitute any prize won or exchange the said Prize for other items. ITS reserves all rights in its sole discretion to substitute any prizes (or prize component, if applicable) with one of equal or greater value. Any imposition of taxes, fees, and any other costs associated with the acceptance and use of the prize is the sole responsibility of the prize winner.


g) By participating in the Campaign, Participants agree to be bound by this Terms and Conditions and ITS' decisions are final and binding. No correspondence or appeals will be entertained. ITS reserves the right to the final and ultimate interpretation of this Campaign.


h) In accepting the prize, the winner agree to participate and cooperate as required in all editorial activities relating to this Campaign. The winner agrees to grant ITS a perpetual and non-exclusive license to use such footage and photographs, voice, biographical information and/or statements, at any time or times, in all media types worldwide for advertising, trade, publicity and promotional purposes and the winner will not be entitled to any fee for such use.
 

i) ITS assumes no responsibility for late entries due to any reasons including, but not limited to, network transmission failure.


j) ITS shall not be responsible for any losses or damages directly or indirectly incurred by any party including the Participant in connection or arising from acts or omissions or in any way related to this Campaign.
 

k) The Participant agrees to discharge and release ITS i from any liabilities and claims (including from breach of contract, tort, negligence or any other cause of actions at law or equity) arising out of or in any way connected to this Campaign or to the Participant’s entry in the Campaign.
 

l) The Participant further agrees to discharge and release any third party which is related to and connected with this Campaign, including Facebook, from any liabilities and claims (including from breach of contract, tort, negligence or any other cause of actions at law or equity) arising out of or in any way connected to this Campaign or to the Participant’s entry in the Campaign.
 

m) By entering into this Campaign, the Participant agrees to indemnify and hold ITS, their officers, directors, shareholders, predecessors, successors in title, employees, agents and representatives harmless from any claims, losses, damages, liability, claims or expenses (including any legal fees), suffered or incurred by ITS due to or in any way arising from this Campaign.
 

n) If any Participants is discovered to be using or have used improper means to participate in this Campaign, ITS reserves the right to cancel the eligibility of the Participant without notice including without hesitation, the commencement of legal proceedings under the full extent of the applicable laws.
 

o) This Campaign and the Terms and Conditions herein shall be governed by the laws of Malaysia. 

 

p) ITS reserves the right to add, modify or substitute any of these Terms and Conditions from time to time as it deems fit.
